The future of DACA is still being litigated in federal courts.
Texas and other conservative states are suing the government and arguing that DACA is unlawful and should end. Once again DACA recipients are left in limbo as they wait for answers about their future in the United States.
Four Make the Road NY team members and members with DACA flew to Texas to hear the oral arguments in Texas v.s. United States Deferred Action for Childhood Arrivals (DACA) case and to speak out for DACA in a demonstration and press conference outside the courthouse. Their presence sends a clear message that DACA is lawful. While we need Congress to act on a pathway to citizenship, DACA has provided an essential lifeline by allowing young people to finish school, apply for work permits, and enjoy temporary protection from detention and deportation.

After today’s hearing, the Texas court could issue a decision anytime and we expect another appeal to follow.
As a result of this case, the federal government has not expanded eligibility for DACA or re-opened it for new applicants. They have also not processed the nearly 80,000 first-time DACA applications from young people who applied in 2021 and have been waiting for a decision since then.
At Make the Road NY, we continue to help DACA recipients renew their protections and organize towards a pathway to citizenship for all 11 million undocumented immigrants in this country.
