Background on 'Public Charge' rule change

The Trump administration’s proposed public charge rule is effectively a wealth test for noncitizens seeking lawful permanent resident status. The rule would redefine the term “public charge,” from a category of people who are institutionalized or otherwise primarily dependent upon public assistance, to include anyone the immigration service deems likely to receive—at any point in the future, even temporarily—small amounts of a wide range of cash or non-cash benefits. These include food assistance, healthcare, and housing assistance.

Potential “public charges” would be denied permanent immigration status and could be subject to removal. The lawsuit notes that this kind of wealth test would most affect immigrants from countries in Latin America, the Caribbean, Africa, and Asia, and argues that it is motivated by animus towards non-white immigrants.

LATEST NEWS ON PUBLIC CHARGE – Updated September 2020

On January 27,2020, the US Supreme Court allowed the new public charge rule to go forward for cases in the United States while the courts review the rules. The Second Circuit Court of Appeals is currently considering whether the public charge rule is unlawful. In late July 2020, the court put a temporary pause of the public charge rule nationwide because of the impact of COVID-19 crisis but on September 11, 2020, the pause was ended by the appellate court.

In our second case, the judge issued an injunction preventing the public charge rule from being applied to applications for visas made abroad!

We will continue to challenge this administration and its awful policies every step of the way!

ÚLTIMAS NOTICIAS SOBRE CARGA PÚBLICA – Actualizado septiembre 2020

El 27 de enero de 2020, la Corte Suprema permitió que la nueva regla de carga publica avanzara para casos adentro de los Estados Unidos mientras los tribunales revisan las reglas. El Tribunal de Apelaciones del Segundo Circuito esta considerado si la regla de carga publica es legal. A fines de julio de 2020, el tribunal suspendió temporalmente la regla de carga pública en todo el país debido al impacto de la crisis de COVID-19, pero el 11 de septiembre de 2020, el tribunal de apelaciones puso fin a la pausa.

¡En nuestro segundo caso, el juez emitió una orden judicial que impedía que la regla de carga publica se aplicara a las solicitudes de visas hechas en el extranjero!
