Re: Biden v Texas

Earlier today, the Supreme Court announced its decision in Biden v. Texas and held that the Biden administration has the legal authority to terminate the Trump-era “Remain in Mexico” policy at our southern border. The Remain in Mexico policy forced thousands of migrants to wait in Mexico while their immigration court cases proceeded in the U.S.

Today’s decision is a small but important victory for the thousands of migrants who were left stranded by this cruel policy and were forced to endure life-threatening conditions near the Mexican-U.S. border. It was obvious in 2019 when the Trump administration first implemented this policy that it was inhumane. The Court had an opportunity to quickly correct-course last year but waited until now to do so.

Although this decision is one bright spot, in a single week, we have witnessed the dismantling of core, long-standing constitutional rights, and the expansion of gun rights–all in an effort to force a right-wing agenda on the entire country. Trump-appointed justices are prioritizing the agenda of right-wing extremists. History and experience teaches us that these types of decisions will disproportionately impact Black, brown and indigenous people.

Democrats and President Biden must use all tools available to them to ensure this inhumane policy, along with other Trump-era policies, never come back, and that our families, communities, bodily autonomy and safety are protected.
